"Pharmacy War"

01.09.2011

On the pages of  BUSINESS newspaper Borys Danevych, a Partner at PARITET law firm, commented the draft regulation on the Abolition of pharmacy kiosks that is stipulated by the Order of the Ministry of Health of Ukraine "On approval of the license terms for the production, wholesale and retail trade of medicines."

Borys Danevych expressed the opinion that this provision in the draft license terms is inconsistent with the requirements of the antimonopoly legislation of Ukraine as it creates discriminatory conditions for the private entrepreneurs as compared to legal entities. "It turns out that pharmacies can only be organized by enterprises, but not by private entrepreneurs - it is an unjustified discrimination. I think that some entrepreneurs will try to create, for example, Ltd., but anyway this will throw them out of the market for some period of time. Moreover, one should be aware that the number of private entrepreneurs that own pharmacies today run into thousand. And can the licensing authority cope with all comers who want to become Ltds? – it’s the question. "
